ToggleWho is a minor child in Romania?
According to Romanian legislation, a minor is a natural person under the age of 18. Until the age of 14, the minor does not have the legal capacity*. The minor who has reached the age of 14 has a limited capacity to exercise legal rights. He/She may enter into legal acts with the prior consent of his/her parents or guardian. Minors who marry acquire full legal capacity.
*The legal capacity of a natural person is the ability to acquire and exercise civil rights and to assume civil obligations.
According to the Law on Citizenship, Law No. 21/1991, minor children acquire Romanian citizenship together with their parents. For this purpose, you must register the application for the acquisition of Romanian citizenship of your children together with your file. In addition, the other parent’s consent it’s necessary by submitting a declaration.
The minor child over 14 years old must fill in a consent declaration and have a valid passport.
What if I didn’t include my child in the citizenship file?
If you did not include your child in your file, or if the child was born after you submitted the file, the child can still obtain the citizenship with you. In this case, you can send the documents related to your child to the Citizenship Authority to include them in your file. On the condition that the application is still pending.
If you have obtained the Romanian citizenship and you haven’t included your child, the only solution is to file a separate file on behalf of your child.
This way, you can register the citizenship file for your minor children directly with the Citizenship Authority in Romania, or through the Romanian Consulate responsible for the area where you currently live. In this case, the legal basis for submitting the citizenship application for your minor children are either Art. 10 paragraph (5), or Article 11 paragraph (2) of Law No. 21/1991.

The applications for the minor children are submitted personally by the parent/s who obtained the Romanian citizenship. Only in cases duly justified by documentary evidence, an appointed person can register the file with a power of attorney.
The application for Romanian citizenship of minor children is processed by order of the President of the Citizenship Authority.
What happens if the child turns 18?
If the child turns 18 during the application process, he/she must take the oath of allegiance to Romania, and consequently receive the Romanian Citizenship Certificate.
